Article 1 – Organiser identity and scope

These Terms and Conditions govern package travel contracts organised and sold under the Voyage Kayak brand by Julien Burellier, a French sole trader (entrepreneur individuel), whose address is 27 rue Pasteur – Côté Jardin, 05100 Briançon, France, SIREN 434 178 075, SIRET 434 178 075 00033, registered with the Atout France register of travel and holiday operators under number IM005130006.

Voyage Kayak may be contacted at info@voyage-kayak.com, on +33 (0)6 38 01 67 35 and at www.voyage-kayak.com. An emergency telephone number or contact point available during the package is stated in the contract, the Road Book or the departure documents.

Financial protection is provided by Groupama Assurance-crédit & Caution, policy no. 4000714710, 3 place Marcel-Paul, 92000 Nanterre, France. Professional liability insurance is provided by MMA IARD, policy no. 127.619.108, 160 rue Henri-Champion, 72030 Le Mans Cedex 9, France. Cover applies to the declared activities of a travel and holiday operator carried out in France and abroad, subject to the limits and exclusions of the policy.

These Terms and Conditions do not govern stand-alone equipment hire, training or coaching services, or contracts concluded with a business traveller for the exclusive purposes of that person’s trade or profession under a general business travel agreement.

In this document, a ‘traveller’ means any person entitled to travel on the basis of the contract. A ‘package’ means the combination of travel services described in the contract. The ‘Road Book’ means the detailed trip information sheet, dated and identified by its version, supplied before the contract is concluded.

Article 2 – Contract documents and order of precedence

The contract consists of the documents supplied to the traveller on a durable medium. They complement one another and shall be interpreted in good faith. In the event of any inconsistency, the following order of precedence applies:

• the signed Booking Contract or, for a private group, the accepted special quotation and any signed annexes;

• the Road Book or trip information sheet, in the version specifically identified in the contract;

• these Terms and Conditions, in the version identified in the contract;

• the standard information form, which summarises the traveller’s key rights;

• mandatory statutory provisions, which always prevail over any conflicting contractual term.

A special condition may depart from these Terms and Conditions only if it is clear, brought to the traveller’s attention before conclusion of the contract and expressly accepted. It may not remove any mandatory right provided by the French Tourism Code or the French Consumer Code.

Article 3 – Pre-contractual information, suitability and formation of the contract

Before booking, Voyage Kayak supplies the traveller with the information required by Articles L. 211-8 and R. 211-4 of the French Tourism Code: the main characteristics, destination, itinerary, duration, dates, accommodation, meals, included transport, visits and activities, group size, language, required level, accessibility, price, payments, minimum group size, formalities, insurance and termination arrangements.

This information is provided through the Road Book, the quotation or offer, the standard information form and these Terms and Conditions. Any change to the pre-contractual information is clearly notified before the contract is concluded.

Where required by the package, the booking is preceded by an exchange enabling Voyage Kayak to assess whether the traveller’s technical experience and declared physical condition are suitable for the demands of the trip. The traveller shall answer questions about experience, autonomy and functional abilities honestly. This assessment is neither a medical examination nor an individual guarantee of successful participation.

Unless expressly stated otherwise, the booking becomes binding once Voyage Kayak has: (i) approved the traveller’s level where such approval is required, (ii) received the signed Booking Contract and (iii) received the deposit specified in Article 6. Voyage Kayak then sends confirmation on a durable medium. For bookings made fewer than 45 days before departure, the full price is payable.

An option, availability enquiry, telephone conversation or unconfirmed form does not reserve a place. Any offer or option remains valid for the period stated in it.

The lead traveller undertakes to provide every participant with the contractual documents and information relevant to them. Each participant remains personally responsible for checking the required formalities, insurance, abilities and equipment.

Package travel contracts are not subject to the 14-day withdrawal period that applies to certain distance contracts. The termination rights provided by the French Tourism Code and these Terms and Conditions remain applicable.

Article 4 – Package characteristics, required level and accessibility

Each Road Book and contract states, in particular, the exact dates, the place and time at which the package begins and ends, its duration, the number of nights, the type and category of accommodation, included meals, included transport and transfers, activities, foreseeable distance or level of commitment, minimum and maximum group size, guiding language, expected technical and physical level, equipment provided and the main accessibility conditions.

Sea kayaking in a natural environment involves variable conditions, including wind, swell, currents, temperature, isolation, launching and landing, carrying equipment, group living, camping and schedules dictated by the conditions. The level description is an essential element of the package. Travellers must seek advice before booking if they are in any doubt.

Before the contract is concluded, the traveller shall disclose any request relating to reduced mobility, disability, allergy, dietary requirement or functional limitation that may affect performance of the package. On the basis of the information supplied, and without acting as a healthcare professional, Voyage Kayak will indicate whether the package appears generally suitable or what reasonable adjustments may be considered.

Medical documents are not collected as a matter of course. Where safe performance of the package requires limited functional information, only data that is strictly necessary will be requested. The traveller remains responsible for obtaining medical advice in the event of doubt or a known medical condition.

Article 5 – Price: inclusions and exclusions

The contract price is stated in euros, inclusive of all taxes, for the services listed as included in the contract and Road Book. The contract states whether the price is per person, based on a specified occupancy, or established for a private group.

Unless expressly stated otherwise, the following are not included: travel to the meeting point and from the place where the package ends; flights, trains or ferries booked personally by the traveller; visas and formalities; personal insurance; drinks or meals not stated as included; personal expenses; gratuities; personal equipment; and optional activities not purchased from Voyage Kayak.

Optional services, cabin or room supplements, additional nights and services requested locally are included only if they have been accepted in writing together with their price.

For a private group, where the price expressly depends on the number of participants, the contract or quotation states the basis of calculation and the adjustment method if a member withdraws. Without a written method, Voyage Kayak may not impose a general and unspecified increase on the other group members. Only the termination fees applicable to the participant concerned and clearly identifiable and justified individual supplements or non-recoverable costs may be charged.

Article 6 – Deposit, balance and non-payment

At the time of booking, the traveller shall pay a deposit equal to 35% of the total package price. Amounts paid are deposits creating a binding commitment and are not cancellation deposits allowing either party simply to withdraw. The balance must be received no later than 45 days before the start of the package. For a booking made 45 days or fewer before departure, the full price is payable at the time of booking.

The payment schedule and accepted payment methods are stated in the contract. Bank charges relating to an international transfer or a transaction in another currency shall be borne by the payer so that Voyage Kayak receives the exact amount invoiced in euros.

In the event of late payment, Voyage Kayak will send a formal notice or reminder on a durable medium and allow a reasonable additional period, unless the imminent departure makes this impossible. If payment is not brought up to date, Voyage Kayak may terminate the contract due to the traveller’s default. The termination fees in Article 9 will then apply, after deducting any cost savings and any services resold or reallocated.

Non-payment does not entitle Voyage Kayak to retain amounts exceeding the appropriate and justifiable fees actually due.

Article 7 – Price revision

After conclusion of the contract, the price is fixed except for a direct and documented change in one of the three categories exhaustively listed in Article L. 211-12 of the French Tourism Code:

• the price of passenger transport resulting from the cost of fuel or other power sources, for transport included in the package;

• the level of taxes or fees imposed by a third party not directly involved in performing the package, including tourist taxes and port, embarkation or disembarkation fees;

• exchange rates relevant to the package.

Price revision operates in both directions: a decrease in the same costs gives rise to a price reduction. For each relevant package, the Booking Contract states the proportion of the price exposed to each category, the reference date and value, the currency, the source of the rate or cost and the calculation method. If the contract does not contain this information for a category, no price increase may be applied for that incomplete category.

Any increase will be notified to the traveller clearly, together with the calculation and supporting evidence, on a durable medium no later than 20 days before the start of the package. No increase is permitted after that date. Voyage Kayak may deduct from a price reduction the actual administrative expenses incurred in calculating and paying it and will provide evidence of those expenses on request.

If the proposed increase exceeds 8% of the total package price, it constitutes a significant change and the rights in Article 12 apply. General supplier increases, inflation or a reduction in margin that do not fall within the three categories above may not be passed on after conclusion of the contract.

Article 8 – Transfer of the contract

The traveller may transfer the contract to a person who satisfies all conditions applicable to the package, including the required level, physical ability, formalities and insurance. The traveller shall notify Voyage Kayak on a durable medium within a reasonable period before departure. Notice received no later than seven days before the start of the package is deemed reasonable, without preventing a later transfer where the service providers accept it.

The transferor and transferee are jointly and severally liable for payment of the balance and any actual fees, charges or other additional costs caused by the transfer. Voyage Kayak will state the amount of those costs and justify that they are reasonable. No arbitrary administration charge will be applied.

A transfer may be impossible where an included travel ticket is issued in a name and cannot be changed, an administrative authorisation can no longer be obtained, or the transferee does not satisfy the essential requirements of the package.

Article 9 – Termination by the traveller and applicable fees

The traveller may terminate the contract at any time before the start of the package. Notice must be given in writing, preferably by email to info@voyage-kayak.com. The relevant date is the date on which Voyage Kayak receives the notice on the durable medium used.

Given the binding commitments incurred for these small-group trips – vessel charters, ferries and equipment transport, accommodation, local services, hire arrangements, guiding and logistics – the following standard termination fees apply to all Voyage Kayak packages:

This scale is a contractual estimate of the costs and losses usually incurred. Fees remain appropriate and justifiable: Voyage Kayak will take account of cost savings, refunds obtained and services resold or reallocated. The traveller may request justification of the amount retained. If the justifiable net loss is lower than the amount produced by the scale, the lower amount will apply. It will never exceed the price of the package.

Fees are calculated on the total price for the participant concerned, including non-refundable contractual options, but excluding any taxes or services actually recovered by Voyage Kayak. Cancellation insurance, if purchased, may cover all or part of these fees in accordance with its own terms.

Voluntary interruption, failure to use a service or withdrawal after the start of the package does not entitle the traveller to a refund for services used or kept available. This rule does not affect the traveller’s rights where a lack of conformity attributable to Voyage Kayak, or a circumstance provided by law, justifies a price reduction, termination or compensation.

Article 10 – Termination without a fee by the traveller

The scale in Article 9 does not apply where the French Tourism Code gives the traveller a right to terminate without paying a fee.

In particular, the traveller may terminate without a fee before departure where unavoidable and extraordinary circumstances occur at the place of destination or its immediate vicinity and significantly affect performance of the package or the carriage of passengers to the destination.

The traveller may also terminate without a fee where, before departure, Voyage Kayak proposes a significant change to an essential characteristic of the package, is unable to meet a special requirement expressly accepted, or proposes a price increase exceeding 8%, in accordance with Article 12.

In these cases, the traveller will receive a full refund of all payments made no later than 14 days after termination. No additional compensation is payable in the case of unavoidable and extraordinary circumstances. An official travel advisory is a relevant factor but is not the only legal test.

A personal circumstance affecting the traveller – illness, accident, refusal of leave, delay to separately booked travel or failure to hold a required travel document – does not in itself constitute an unavoidable and extraordinary circumstance at the destination. The standard scale applies, together with the traveller’s personal insurance where relevant.

Article 11 – Minimum group size and cancellation by Voyage Kayak

The minimum number of participants is stated in the contract and Road Book. Voyage Kayak may terminate the contract if that number is not reached, provided it notifies the traveller no later than:

• 21 days before the start of a package lasting more than six days;

• seven days before the start of a package lasting between two and six days;

• 48 hours before the start of a package lasting less than two days.

The contract may specify an earlier cancellation date that is more favourable to the traveller, but never a date later than the statutory time limits. Where the package is cancelled because the minimum number has not been reached, all payments will be refunded no later than 14 days after termination and no additional compensation will be payable.

Voyage Kayak may also terminate the contract where it is prevented from performing it because of unavoidable and extraordinary circumstances and gives notice without undue delay before the start of the package. Payments will be refunded within 14 days, with no additional compensation.

If Voyage Kayak cancels for another reason that does not fall within a statutory exemption, the traveller retains the rights to a refund and, where applicable, compensation provided by the French Tourism Code.

Article 12 – Changes before the start of the package

Voyage Kayak may make a minor change to the contract before departure if the contract reserves that right and the traveller is informed in a clear, comprehensible and prominent manner on a durable medium.

If Voyage Kayak must significantly alter a main characteristic of the package, is unable to meet an accepted special requirement, or proposes a price increase exceeding 8%, it will inform the traveller without undue delay of the proposed change, its effect on the price, the reasonable response period and the consequences of failing to respond. Where applicable, Voyage Kayak will also state the substitute package offered and its price.

Within the stated period, the traveller may accept the change or terminate the contract without paying a fee. In the event of termination, all payments will be refunded no later than 14 days afterwards. If the traveller accepts a substitute package of lower quality or cost, the traveller is entitled to an appropriate price reduction.

Whether a change is minor or significant is assessed in the context of the contract as a whole, the sporting and nautical purpose of the trip, its duration, accommodation, itinerary, included services and the actual effect on the traveller.

Article 13 – Adaptations during the package and alternative arrangements

Sea kayaking and activities in natural environments depend on weather and sea conditions, decisions by the authorities, access conditions, wildlife, service-provider availability and group safety. The guide may change schedules, stages, itineraries, paddling areas, campsites, the order of activities and the way in which the support vessel or equipment is used, provided the adaptation is necessary and proportionate.

An adaptation that preserves the overall nature, duration and quality of the services, without substantially reducing their value, does not necessarily constitute a lack of conformity. Voyage Kayak will explain the reason and seek the closest solution to the original programme.

Where a significant proportion of the services cannot be provided as agreed, Voyage Kayak will offer suitable alternative arrangements at no additional cost, where possible of equivalent or higher quality. If they are of lower quality, the traveller is entitled to an appropriate price reduction.

The traveller may reject the alternative arrangements only if they are not comparable with what was agreed or the proposed price reduction is inadequate. If a lack of conformity substantially affects performance of the package and is not remedied within a reasonable period set by the traveller, the traveller may terminate without a fee in accordance with the law.

Where the package includes carriage of passengers and no other solution is possible, Voyage Kayak will provide repatriation by equivalent transport at no additional cost. If unavoidable and extraordinary circumstances prevent the return journey, Voyage Kayak will bear the cost of necessary accommodation subject to the limits and exceptions in Article L. 211-16 of the French Tourism Code.

Article 14 – Safety and participant obligations

Each participant shall behave prudently, supportively and in a manner compatible with group life. Participants must comply with instructions given by the guide, captain and service providers, wear the prescribed safety equipment, use equipment as instructed and immediately report any difficulty or damage.

Each participant must be able to swim to the standard stated in the Road Book, possess the declared technical and physical abilities and not take part while under the influence of alcohol, illegal drugs or any substance that dangerously impairs their abilities. Participants must bring the compulsory personal equipment stated in the kit list.

The guide has the operational authority required for safety. The guide may require a pause, an adaptation, paddling in a crew, a restriction on activity or an alternative plan. In the event of dangerous behaviour, repeated refusal to follow instructions, violence, harassment or a manifestly unsuitable level that endangers the participant or the group, Voyage Kayak may, after a warning where the urgency allows, suspend or end that person’s participation.

Exclusion does not automatically result in forfeiture of all payments. Services already performed, non-recoverable commitments and reasonable additional direct costs attributable to the participant’s conduct remain payable; any savings and refunds obtained will be deducted. Return travel or accommodation costs made necessary by the participant’s fault may be charged against supporting evidence, without prejudice to mandatory rules on liability and assistance.

The traveller is responsible for damage caused through their fault to equipment, accommodation or third parties. Normal wear and tear, damage resulting from inappropriate instructions or an event not attributable to the traveller may not be charged to them.

Article 15 – Travel formalities, health and insurance

Before the contract is concluded, Voyage Kayak provides the general information known to it regarding passport, visa and health formalities applicable to nationals of the European Union or European Economic Area, together with approximate processing times. Nationals of other countries and persons with particular circumstances must consult their consular authorities and inform Voyage Kayak sufficiently in advance.

Each traveller shall check the validity, condition and consistency of their documents, including for stopovers, and complete all formalities within the required time. The consequences of denied boarding or entry resulting from a missing, expired or non-compliant document are the traveller’s responsibility, unless caused by incorrect information attributable to Voyage Kayak.

The traveller shall consult official health and safety advice and carry any personal medication. Voyage Kayak does not act in place of a doctor or consular authority. Individual advice must be sought from a healthcare professional.

Unless the contract states otherwise, the package does not include cancellation, curtailment, baggage, personal liability, assistance or repatriation insurance.

Each participant must have cover appropriate to the relevant destinations and activities, including at least medical treatment, hospital care, assistance and repatriation. Where required by the Road Book, cover must also include search and rescue, evacuation and sea-kayaking activities in remote areas, without exclusions incompatible with the itinerary. Evidence of insurance may be requested before departure.

The traveller is free to choose an insurer. If compulsory cover remains absent after a request to remedy the position and this makes participation dangerous, unlawful or materially impossible, Voyage Kayak may refuse departure. The termination fees in Article 9 will apply, subject to any cost savings.

Article 16 – Travel outside the package and baggage

International or domestic flights, ferries, trains, airport hotels, transfers or other travel booked and paid for directly by the traveller do not form part of the Voyage Kayak package unless expressly stated in the contract. The package begins and ends at the places, dates and times precisely stated in the contract.

The traveller shall organise travel to and from the package with a margin appropriate to ordinary delay risks and should choose flexible or refundable tickets. Where departure of the package depends on a minimum group size or logistical confirmation, travellers are advised to wait for written confirmation that the departure is guaranteed before purchasing a non-refundable ticket.

Voyage Kayak is not responsible for performance of a transport contract purchased directly by the traveller from a third party. This exclusion does not apply where the loss results from Voyage Kayak’s own fault, including incorrect contractual information about the meeting place or time.

The traveller shall comply with baggage limits and communicated safety requirements. Valuables, documents, medication and payment methods remain under the traveller’s supervision. The rules of the relevant carrier or service provider apply to baggage entrusted to it, without reducing the traveller’s rights against Voyage Kayak where the service forms part of the package.

Article 17 – Liability, lack of conformity and assistance

In accordance with Article L. 211-16 of the French Tourism Code, Voyage Kayak is legally responsible for performance of the services included in the contract, whether performed by Voyage Kayak or by other service providers, without prejudice to its right of redress against them.

The traveller shall inform Voyage Kayak without undue delay, taking the circumstances into account, of any lack of conformity identified during performance of the package. The traveller shall use the emergency number or contact details in the travel documents. Voyage Kayak will remedy the lack of conformity unless this is impossible or entails disproportionate costs, taking into account its extent and the value of the affected services.

If Voyage Kayak does not remedy the lack of conformity within a reasonable period set by the traveller, the traveller may do so personally and request reimbursement of the necessary expenses. In an emergency, the traveller is not required to set a prior time limit.

The traveller is entitled to an appropriate price reduction for any period during which there is a lack of conformity, unless Voyage Kayak proves that it is attributable to the traveller. The traveller may also claim compensation for loss, unless Voyage Kayak proves that the loss is attributable to the traveller, to a third party unconnected with the travel services where the event was unforeseeable or unavoidable, or to unavoidable and extraordinary circumstances.

Where international conventions limit the conditions or amount of compensation payable by a service provider, the same limits may apply to Voyage Kayak. Except in cases of personal injury or damage caused intentionally or through negligence, any contractual limitation of compensation may not be less than three times the total price of the package.

Voyage Kayak will provide appropriate assistance to a traveller in difficulty, including information on health services, local authorities and consular assistance, and help with communications or finding alternative travel services. If the difficulty is caused intentionally or through the traveller’s negligence, Voyage Kayak may charge the actual cost of that assistance up to the expenses actually incurred.

Claims for a price reduction or damages under the French Tourism Code are subject to a two-year limitation period, without prejudice to any different mandatory period applicable to the nature of the loss.

Article 18 – Special requirements, accommodation, meals and minors

Any special requirement – dietary needs, sleeping arrangements, cabin, proximity, specific equipment or assistance – must be stated before the contract is concluded. It becomes contractually binding only if Voyage Kayak expressly accepts it on a durable medium. Merely passing a request to a service provider does not constitute acceptance.

Space, privacy, water, electricity and facilities may be limited on a vessel, in a mountain hut, guesthouse, campsite or remote accommodation. The contract and Road Book describe the category and occupancy conditions. Room, tent or cabin arrangements may be adapted to comply with capacity and safety requirements, without changing a private option expressly purchased.

Voyage Kayak will endeavour to accommodate notified and accepted dietary requirements within the supply constraints of remote destinations. A severe allergy or risk of cross-contamination must be disclosed before booking. The absence of a medical environment or separate kitchen may make the trip unsuitable.

Minors are accepted only when accompanied by at least one legal guardian participating in the same package, or subject to arrangements expressly approved in writing by their legal guardians. Voyage Kayak does not accept unaccompanied minors or school groups under these Terms and Conditions. The accompanying adult remains responsible for the minor outside supervised activity periods and must ensure that instructions are followed.

Article 19 – Complaints and mediation

To allow a solution to be found locally, any lack of conformity must be reported without delay during the package using the emergency contact details provided. After the package, a detailed complaint with relevant supporting documents may be sent to Voyage Kayak – 27 rue Pasteur – Côté Jardin, 05100 Briançon, France – or to info@voyage-kayak.com.

Voyage Kayak will acknowledge receipt and respond within a reasonable period. Failure to complain within an internal time limit does not extinguish the traveller’s statutory rights, although it may make it more difficult to establish the facts or remedy a problem that could have been resolved locally.

Mediation is optional for the consumer and does not prevent either party from bringing proceedings before a court with jurisdiction. The case must satisfy the admissibility requirements of the French Consumer Code and the appointed mediator.

Article 20 – Personal data and image rights

Julien Burellier, a French sole trader operating under the Voyage Kayak brand, is the controller of processing necessary for providing information, booking, performance of the package, invoicing, safety, handling complaints and complying with legal obligations.

Necessary data is processed for performance of the contract and compliance with legal obligations. Contact details may be disclosed, strictly to the extent necessary, to accommodation providers, included carriers, guides, local representatives, authorities, insurers or service providers involved in the package.

Where the trip takes place outside the European Economic Area, certain strictly necessary data may be transferred to the local service provider or authority in accordance with the mechanisms provided by the General Data Protection Regulation, including where the transfer is necessary for performance of a contract concluded in the traveller’s interests.

Contract and complaint documents are generally retained for the duration of the relationship and then for five years; accounting records for ten years; and marketing data for three years after the last contact, subject to an objection. Functional or health information exceptionally disclosed for safety purposes is retained only for the time necessary for the package and the handling of any incident or claim.

The traveller may exercise the rights of access, rectification, erasure, restriction, objection and, where the conditions are met, data portability by writing to info@voyage-kayak.com or Voyage Kayak’s postal address. A complaint may be lodged with the French data protection authority, the CNIL.

Electronic marketing requires consent or must fall within a statutory exception; every message includes a simple means of opting out. Identifiable photographs or videos used for promotional purposes require separate, optional and sufficiently specific consent. Refusal has no effect on the booking.

Article 21 – Governing law, language and final provisions

The contract is governed by French law, subject to any more protective mandatory provisions of which a consumer may not be deprived under the law of their country of habitual residence.

Any dispute will be heard by the courts having jurisdiction under the applicable legal rules. No term requires a consumer to bring proceedings exclusively before a court located at Voyage Kayak’s registered address.

The language of the contract is the language stated in the Booking Contract. Where a translation is supplied, Voyage Kayak will ensure that it is consistent with the French version. In the event of any discrepancy, the French version shall be used as the reference to the extent permitted by applicable mandatory rules, without depriving the traveller of information validly supplied in the agreed language.

If any term is held to be invalid or unenforceable, the remaining terms will continue in force. Failure to exercise a right immediately does not constitute a waiver.

The applicable version is the version supplied and accepted when the contract is concluded. A later change to these Terms and Conditions does not apply retrospectively to a confirmed booking, unless agreed by the parties or required by a mandatory rule of law.

This version applies to contracts concluded from its date of publication. Contracts concluded earlier remain governed by the version supplied to the traveller when they were concluded, subject to mandatory statutory provisions.

Annex 1 – Standard information form

Form applicable to package travel contracts in situations other than those where a hyperlink is used – Annex 1, Part B, of the French Order of 1 March 2018.

Additionally, as required by law, Voyage Kayak has protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event of insolvency.

Key rights

• Travellers will receive all essential information about the package before concluding the package travel contract.

• The organiser and the retailer are responsible for the proper performance of all the travel services included in the contract.

• Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the organiser or the retailer.

• Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.

• The price of the package may be increased only if specific costs rise, if this possibility is expressly provided for in the contract, and never later than 20 days before the start of the package. If the price increase exceeds 8% of the package price, the traveller may terminate the contract.

• If the organiser reserves the right to increase the price, the traveller is entitled to a price reduction if the relevant costs decrease.

• Travellers may terminate the contract without paying a termination fee and receive a full refund if an essential element of the package, other than the price, is changed significantly. If the trader cancels before the start of the package, travellers may obtain a refund and, where appropriate, compensation.

• Travellers may terminate the contract without paying a termination fee before the start of the package in the event of exceptional circumstances, for instance serious security problems at the destination likely to affect the package.

• Travellers may terminate the contract at any time before the start of the package in return for an appropriate and justifiable termination fee.

• If, after the start of the package, significant elements cannot be provided as agreed, suitable alternative arrangements must be offered at no additional cost. Travellers may terminate the contract without paying a termination fee where the services are not performed in accordance with the contract, this substantially affects performance of the package and the organiser fails to remedy the problem.

• Travellers are entitled to a price reduction and/or compensation where the travel services are not performed or are improperly performed.

• The organiser or retailer must provide assistance if the traveller is in difficulty.

Insolvency protection

Voyage Kayak has taken out insolvency protection with Groupama Assurance-crédit & Caution, policy no. 4000714710. If Voyage Kayak becomes insolvent, payments made will be refunded. If insolvency occurs after the start of the package and transport is included in the package, travellers’ repatriation is guaranteed.
