Voyage Kayak pays particular attention to the protection of the personal data of its customers, travellers, prospective customers and users of the website https://voyagekayak.com.

Depending on the nature of your relationship and correspondence with Voyage Kayak, the following personal data may be collected:

– first name and surname;
– postal address;
– email address;
– telephone number;
– nationality and country of residence;
– information relating to the requested or booked trip;
– information provided in booking forms and travel contracts;
– information concerning kayaking experience, technical ability, height, weight or physical suitability where necessary for equipment selection and assessment of the suitability of a particular trip;
– correspondence with Voyage Kayak;
– information required for invoicing and payment monitoring;
– preferred language and destinations selected when subscribing to the newsletter;
– technical connection and browsing data, subject to the user’s cookie preferences.

Voyage Kayak does not ask website users to provide medical records or medical certificates.

Users are requested not to send health or medical information unless it is genuinely necessary for the organisation and safety of their trip.

3.1 Enquiries

Personal data sent by email or through a form are used to answer enquiries, provide information about trips and prepare a possible booking.

The lawful basis is taking pre-contractual steps at the request of the individual concerned or, depending on the nature of the enquiry, Voyage Kayak’s legitimate interest in responding to enquiries.

3.2 Bookings and Performance of Travel Contracts

Personal data provided in booking forms, contracts and correspondence are used to:

– assess the booking request;
– determine whether the participant’s declared experience and abilities are appropriate for the chosen trip;
– select or prepare suitable equipment;
– organise and provide the trip;
– communicate practical information;
– manage the booking, contract, invoicing and accounting;
– manage any complaints or legal claims.

The lawful bases are taking pre-contractual steps, performing the travel contract, complying with Voyage Kayak’s legal obligations and, where appropriate, Voyage Kayak’s legitimate interest in organising its activities safely and appropriately.

3.3 Newsletter

The subscriber’s first name, surname, email address, preferred language and destination interests may be used to send Voyage Kayak newsletters.

This processing is based on the subscriber’s consent.

Subscription to the newsletter is optional. Consent may be withdrawn at any time by using the unsubscribe link included in each email or by contacting info@voyage-kayak.com.

The newsletter is managed and sent using Mailchimp, a service operated by The Rocket Science Group LLC, part of the Intuit group.

3.4 Audience Measurement

Subject to the user’s consent, Voyage Kayak uses Google Analytics to obtain statistics about website traffic and general website use.

The data collected may include the pages visited, interactions with the website, device and browser information, an approximate geographical area and technical connection data.

Google Analytics must only be activated after the user has given consent through the cookie management banner.

3.5 Website Security

This processing is based on Voyage Kayak’s legitimate interest in maintaining the security of its website and preventing unauthorised access.

Fields identified as mandatory in a form are required in order to process the corresponding request.

If information necessary to assess a booking or perform a travel contract is not provided, Voyage Kayak may be unable to confirm the booking or provide the requested service.

Newsletter subscription and consent to non-essential cookies are entirely optional. Refusing them does not prevent access to the essential content of the website.

  1. Recipients of Personal Data

To the extent necessary for their duties, personal data may be accessible to:

– Julien Burellier and persons specifically authorised to work for Voyage Kayak;
– guides and activity leaders involved in the relevant trip;
– service providers necessary for the performance of the trip, including accommodation providers, boat operators, local service providers and transport providers included in the programme;

Voyage Kayak does not sell or rent the personal data of its customers or website users.

  1. Transfers Outside the European Economic Area

Some trips are organised in countries outside the European Economic Area.

Where necessary for the performance of the travel contract, strictly necessary personal data may be shared with service providers located in the destination country.

Such transfers are limited to the information required to book or provide the services requested by the traveller.

Mailchimp and certain Google services may also involve the processing of personal data in the United States. Depending on the circumstances, these transfers are safeguarded by an adequacy decision, the EU–US Data Privacy Framework or Standard Contractual Clauses approved by the European Commission.

  1. Retention Periods

Personal data are retained for the following periods:

– enquiries that do not result in a booking: three years from the last contact initiated by the individual;
– customer files and documents required for the trip: for the duration of the contractual relationship and then in restricted archives for the period necessary to protect Voyage Kayak’s legal rights, generally five years;
– invoices and accounting documents: ten years, in accordance with French legal requirements;
– technical information relating to experience, height, weight, physical suitability or equipment selection: until the end of the trip and for no longer than one year afterwards, unless an incident, complaint or legal requirement justifies longer retention;
– newsletter information: until consent is withdrawn or no later than three years after the subscriber’s last active contact;
– Google Analytics user-level data: no longer than fourteen months;
– technical security logs: no longer than twelve months, unless longer retention is required in connection with a security incident.

Certain information may be retained for a longer period in restricted archives where required by law, legal proceedings or an existing dispute.

Under the General Data Protection Regulation, or GDPR, and the amended French Data Protection Act, individuals have, where applicable:

Voyage Kayak will respond within the period provided by law, normally within one month.
